Elder Abuse: Attorney for Property sentenced to jail for neglect of vulnerable adult

We referred to this shocking case in a previous blog post about the issues and consequences facing older adults who prefer to remain at home rather than be admitted to long-term care (view post). The Deceased’s adult daughter, who was acting as her mother’s Attorney for Property, and the daughter’s husband were charged and convicted for failing to provide the necessities of life to the elderly mother, who died in deplorable conditions.

The Honourable Justice Guy DiTomaso has now sentenced the couple to one year in jail and two years’ probation. We will post the decision if/when it is reported. In the meantime, Tracy McLaughlin for the Toronto Sun has been covering the legal proceedings, and provides this detailed and graphic report of the inhumane conduct that attracted this sentence.

Ms. McFarlane reports:

“…defence lawyers asked for conditional sentences to be served at home, the judge insisted a jail sentence is necessary to discourage similar crimes. “Elder abuse is a growing problem in this society,” DiTomaso said. “In my view a jail sentence is the only reasonable sentence to protect these vulnerable people who are in the care of others.”
